The Supreme Court asked Justice Verma why he appeared before the internal inquiry committee and why he did not challenge it there. The court told Justice Verma that he should have come to the Supreme Court first against the committee report. A bench of Justice Dipankar Dutta and Justice AG Masih said that if the Chief Justice of India has any documents to believe that a judge has violated decency, he can inform the President and the Prime Minister.
Senior advocate Kapil Sibal, appearing for Justice Verma, said that the internal inquiry committee's recommendation for his removal is unconstitutional. Sibal told the court that recommending such action would set a dangerous precedent. He said Justice Yashwant Verma first approached the Supreme Court because the tape had already been released and his image had already been tarnished. The hearing of the case is currently ongoing.
