Though there is a difference between Articles 16(1) and 16(3) of the Constitution, it only prohibits reservation by the state in private sector jobs and not in local cadres.
Article 371 of the Constitution empowers states to make "direct recruitment of local cadres" in specified areas.
a) Based on the above, Class III and Class IV jobs in Uttarakhand are reserved for locals who must have resided there for at least 15 years.
b) Since the state government can set eligibility criteria for employment, they make certain criteria that can only be met by people domiciled in the state. For example, the Assam government has also decided to give reservation in state government jobs only to its domiciles.
c) In Maharashtra, only local residents fluent in Marathi and domiciled in the state and living there for more than 15 years can apply for state jobs.
d) Before the repeal of Article 370, all government jobs in Jammu and Kashmir were reserved for state subjects. However, currently government jobs are reserved for domiciles. A person who has lived in the state for 15 years is a domicile. Those who have studied in Jammu and Kashmir for seven years and have passed class 10 and 12 exams from there are also domiciles.
e) Arunachal has 100 per cent tribal population and their government provides 80 per cent reservation to only tribes.
f) Meghalaya has only three communities - Khasi, Jaintia and Garo, and their government provides 80 per cent reservation to these communities.
States like Andhra Pradesh, Himachal Pradesh and Haryana are also providing reservation in state government jobs to their domiciles.
So, the residents of Chandigarh feel cheated as they have been living here for decades and giving their best, but when it comes to jobs for their children, there is no security. Though Chandigarh is the capital of Punjab and Haryana, both these states do not consider the residents of Chandigarh as their own. From this point of view, if reservation is not provided in UT cadre jobs for the domiciled citizens of Chandigarh, it would be a great injustice.
