New Delhi: The right to marry is a part of the human freedom and right to life granted to citizens in the Indian Constitution. The Delhi High Court has said these things in its decision on Monday. The High Court said that when two adults decide to get married with their consent, no obstacle can be created by parents, society or the government.
The court said this when a couple sought police protection from the court. The couple has said in their petition that they got married against their parents and that is why their family members were constantly threatening them. For this reason they should be provided with protection.
The Delhi High Court has ordered to provide adequate security to the victim couple. The court said that the petitioner has every right to marry the person of his choice. They do not need any social acceptance of their decisions and choices. The court has asked the concerned police chief to take necessary steps for the safety of both.
Justice Saurabh Banerjee said that the right to marry the person of one's choice is not only enshrined in human rights but is also an important part of Article 21 of the Constitution of India. This article guarantees citizens their right to life.
The Supreme Court also recognized it
The justice said that the Supreme Court has recognized the right of every person to marry the person of their choice and Article 21 of the Constitution of India protects life and personal liberty to all people. It includes the inherent rights of every person, especially regarding marriage.
The High Court said that thus the petitioners are genuinely entitled to protection under Article 21 of the Constitution of India. The respective SHOs and Beat Constables of the area will take all possible steps to provide them with the necessary assistance and security as per law.
