Haryana Government Notifies Contractual Employees Rules.

Chandigarh, August 6-Haryana Government has notified the Haryana Contractual Employees (Security of Service) Rules, 2025. These rules have been notified under sub-section (1) of section 10 of the Haryana Contractual Employees (Security of Service) Rules, 2024 (17 of 2024). With this, the services of thousands of employees working in various departments, boards, corporations and authorities of the state have been secured.

These rules have been notified under sub-section (1) of section 10 of the Haryana Contractual Employees (Security of Service) Rules, 2024 (17 of 2024). With this, the services of thousands of employees working in various departments, boards, corporations and authorities of the state have been secured.
According to the notification issued in this regard by Chief Secretary Mr. Anurag Rastogi, any contractual employee will have to complete at least 5 years of service by August 15, 2024 to get the status of a protected employee, in which he has received salary for at least 240 days of work in each year. If an employee has been appointed to both higher and lower posts in the same year, the service will also be counted, provided that he has drawn 240 days' pay.
In particular, in the case of employees who were earlier appointed to permanent posts but their services were terminated due to cancellation or revision of the merit list by the Haryana Staff Selection Commission, their previous service on permanent basis, excluding the gap between permanent and contractual service, will also be included in the eligibility of 5 years. Also, the service rendered in various departments or institutions under the control of the State Government will be easily added.
If a person is married to a person whose spouse is alive or who has married a person despite having a living spouse, he will not be eligible for the benefit of service protection under the Act. However, if the Government is satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for doing so, it may exempt any person from the effect of this rule.
If the relevant post is easily identified, the Government organization shall create supernumerary posts for the protected employee with effect from 16th August 2024. If the relevant post is not identified or the nomenclature of the post of the eligible contractual employee is different from the existing approved post, the Government organization concerned shall send a proposal for additional posts with the proposed pay scale, necessary educational qualifications and work distribution to the Government with effect from 16th August 2024. The Government shall approve this proposal within 90 days in consultation with the Finance Department and thereafter an order of protection of service shall be issued.
If the number of protected employees in any department is more, their list shall be sent to the Government and they shall be adjusted in other departments as required. The appointing authority shall have the right to transfer any protected employee within or outside Haryana in the public interest.
For the determination of remuneration, the figure obtained shall be rounded up to approximately 100 after adding an increment of at least 5% or 10% or 15%, as the case may be, of the working pay scale approved by the Finance Department at the time of sanction of supernumerary post.
The protected employees shall get an annual pay increment once a year in the working pay scale. The date of increment of remuneration shall be 1st January or 1st July every year, provided that the employee has completed at least 6 months of qualifying service before that date. The first increment of remuneration shall be payable on 1st July 2025 on completion of eligibility. These employees shall also be payable dearness allowance at the same rate as regular employees from 1st January 2025.
These employees shall continue to get normal leave and medical leave as before. Women protected employees will get two days of general leave every month and a maximum of 22 days in a year, whereas earlier they were getting only 10 days of general leave.
Apart from this, a service book of each protected employee will also be prepared by the concerned department. Until separate rules are framed, protected employees will be governed by the Haryana Civil Services Rules 2016 and the Haryana Civil Services (Punishment and Appeal) Rules 2016.
