Hoshiarpur- According to the order issued by District Magistrate-cum-Deputy Commissioner Ashika Jain under the powers conferred under Section 163 of the Indian Civil Security Act 2023, any kind of noise pollution/excessive noise making equipment, musical instruments and any kind of noise pollution, noise, threat will be banned in the district. This ban will not apply only to firecrackers and color producing fireworks.
Similarly, there will be a complete ban on any type of pressure horn, different music and any kind of noise pollution, noise, threat, excessive noise in vehicles etc. Only horns prescribed by the government which are free from noise pollution can be played at the prescribed volume. Apart from this, there will be a complete ban on playing loud and obscene music and songs in any non-government building, commercial shops, public place, cinema, mall, hotel, restaurant and fair etc.
There will be a complete ban on the use/installation of fireworks/crackers/loud speakers/pressure horns and noise making equipment within 100 meters of silence zone in any area declared as silence zone by the Ministry, Forest, Hospital, Educational Institution, Court, Religious Institution or Competent Authority. Similarly, during special circumstances and occasions, loud speakers in religious places/pandals and DJ/orchestra in authorized marriage palaces will not be operated without the written permission of the concerned Sub-Divisional Magistrate with the conditions mentioned in the Punjab Instruments (Noise Control) Act, 1956.
According to the order issued, despite taking the necessary approval from the concerned Sub-Divisional Magistrate, as per the guidelines issued by the Hon'ble Supreme Court of India, the noise limit of loud speakers/DJ/musical instruments/address systems etc. being operated by any person at any place has been determined as the noise standard limit of the respective place.
Under this, the noise level in industrial establishments will not exceed 75 dB(A) during the day and 70 dB(A) during night, 65 dB(A) during the day and 55 dB(A) at night in commercial areas, 55 dB(A) during the day and 45 dB(A) at night in residential areas and 50 dB(A) during the day and 40 dB(A) at night in quiet areas. This restriction is applicable during the day time i.e. from 6 am to 10 pm. This order will not be applicable on government machinery and in emergency situations. This order will remain in force till 7 May 2025.
