Ban on Digging or Deepening Borewells Without Approval - Deputy Commissioner

Nawanshahr- The District Magistrate, Ankurjit Singh, has issued orders imposing a ban on digging or deepening borewells without approval in the district, making it mandatory to obtain conditional permission from the competent authority.

According to the issued orders, in light of the Supreme Court’s ruling passed on 11.02.2010 in Writ Petition (Civil No. 36 of 2009), and in compliance with the guidelines issued by the Ministry of Jal Shakti, Government of India, a ban has been imposed on digging or repairing borewells/tubewells in both urban and rural areas, including open wells and tubewells. 
The District Magistrate stated that due to the risk of people and children falling into these borewells, a ban has been imposed on digging or deepening borewells without approval in the district, and conditional permission from the competent authority has been made mandatory.
 It is noteworthy that, under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, it is mandatory for landowners to notify the concerned District Collector, Gram Panchayat, Municipal Council, Public Health Department, and Groundwater Department at least 15 days in advance before digging a borewell. 
Additionally, a signboard displaying the name and registration number of the drilling agency, along with the complete name and address of the landowner, must be placed near the borewell site. It is mandatory to secure the borewell with barbed wire and cover it with a steel plate fastened with nuts and bolts. 
A cement/concrete platform, 0.30 meters below and 0.30 meters above ground level, must be constructed around the borewell. Furthermore, any empty space around the well/borewell after digging or repair must be filled with soil, and the ground level must be restored to its original state after completion of the work. 
Under no circumstances should a well or borewell be left uncovered. Any person intending to dig or repair a well/borewell must obtain written approval from the Water Supply and Sanitation Department and shall not carry out the work without their supervision.
 Similarly, in rural areas, the Sarpanch and Agriculture Department officials, and in urban areas, the Public Health Department, Groundwater Department, Junior Engineers, and Executive Engineers of Municipal Councils, are required to prepare regular reports regarding their respective jurisdictions and submit them to the Additional Deputy Commissioner (Development) every month. These prohibitory orders will remain in effect until September 30, 2025.

Ban on Installing Tubewells and Submersible Pumps Without Approval in Notified Areas-
In a separate order, the District Magistrate, in view of incidents of dacoity and robbery at petrol pumps and banks, has mandated the installation of CCTV cameras at every bank and petrol pump in the district under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023. According to the District Magistrate, these CCTV cameras must have a minimum recording capacity of 7 days. The Senior Superintendent of Police (SSP), District Food and Supply Controller, and Lead Bank Manager will be responsible for enforcing this order. This order will remain in effect until September 30, 2025. 
Similarly, the District Magistrate has issued orders banning the installation of tubewells/submersible pumps without approval in the notified areas (Blocks Aur and Banga). He stated that if anyone wishes to install a tubewell/submersible pump as per the approved activities under the Central Ground Water Authority’s guidelines, they must apply for a No Objection Certificate (NOC) at the authority’s office and obtain approval. 
The responsibility for inspecting unauthorized tubewells/submersible pumps has been assigned to the concerned Block Development and Panchayat Officer in villages and the concerned Executive Officer of the Municipal Council in cities. The SSP, Block Development and Panchayat Officers of Aur/Banga, and the Executive Officer of Banga Municipal Council will be responsible for enforcing these orders. These orders will remain in effect until September 30, 2025.


Ban on Public and Social Media Display of Weapons in the District-
District Magistrate Ankurjit Singh, under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has issued orders imposing a complete ban on carrying or displaying weapons at marriage palaces/resorts, fairs, religious places, processions, wedding parties, other events/public gatherings, and educational institutions in the district. 
According to the issued orders, this ban also applies to the public display of weapons and their display on social media. The District Magistrate stated that songs glorifying weapons or violence are also covered under this prohibition. 
Additionally, the Senior Superintendent of Police, Shaheed Bhagat Singh Nagar, will conduct surprise checks in various areas. An FIR will be registered, and strict action will be taken against anyone delivering hate speeches against any community. This order will remain in effect until September 30, 2025.
